1. Acceptance of Terms

Welcome to SingVerses! By accessing or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

SingVerses is a mobile application that provides access to religious songs and hymns with audio playback capabilities. The App allows users to:

  • Browse and search a collection of religious songs and hymns
  • Play audio recordings of songs
  • Create and manage user accounts
  • Subscribe to premium features
  • Access content based on subscription tiers

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the App, you must register for an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account

3.2 Organization Codes

Some accounts require an organization code for registration. You are responsible for ensuring you have proper authorization to use any organization code provided.

4. Subscription and Payment Terms

4.1 Subscription Tiers

The App offers multiple subscription tiers ranging from 5 to 5,000+ users with varying annual pricing.

4.2 Payment and Billing

  • All subscriptions are billed annually
  • Payment is processed through our third-party payment processor, Stripe
  • You are responsible for all applicable taxes
  • Subscription fees are non-refundable except as required by law

4.3 Subscription Changes

  • Upgrades to higher tiers take effect immediately
  • Downgrades take effect at the next billing cycle
  • Cancellation will result in loss of access at the end of the current billing period

5. User Content and Conduct

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Upload, post, or transmit any content that is harmful, offensive, or inappropriate
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Use the App to distribute malware or engage in hacking activities

5.2 Intellectual Property

All content provided through the App, including but not limited to audio recordings, text, graphics, and software, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit permission.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your personal information.

7. Disclaimers and Limitations of Liability

7.1 Service Availability

The App is provided "as is" without warranties of any kind. We do not guarantee that:

  • The App will be available at all times
  • The App will function without errors or interruptions
  • Audio content will always be available or of specific quality

7.2 Limitation of Liability

To the maximum extent permitted by law, SingVerses shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or other intangible losses
  • Any damages arising from your use of the App

7.3 Third-Party Services

The App may integrate with third-party services (such as Supabase for data storage and Stripe for payments). We are not responsible for the availability, accuracy, or practices of these third-party services.

8. Indemnification

You agree to indemnify and hold harmless SingVerses, its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion features in the App.

9.2 Termination by Us

We may terminate or suspend your account and access to the App at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

9.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 7, 8, and 10.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms in the App
  • Sending an email notification (where applicable)
  • Displaying a notice in the App

Your continued use of the App after such changes constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App will be resolved through:

  1. Good faith negotiations between the parties
  2. Binding arbitration (if negotiations fail)
  3. Courts of competent jurisdiction as a last resort

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and SingVerses regarding the use of the App and supersede all prior agreements and understandings.
